WHO IS RESPONSIBLE OF YOUR PERSONAL DATA?

AND MICROAREA NEXT, S.L.U.), with address at 2810 N Church, St Wilmington, DE, 19802 (hereinafter “MICROAREA”) through online forms or when making a purchase on its website.
For the purposes of this Privacy Policy, “User” shall mean any individual interested in the products and services offered by MICROAREA through its web pages. MICROAREA, as the data controller, shall request, prior to providing personal data, the User’s express consent to this Privacy Policy, when necessary, and to any other aspect that requires the User’s prior authorization. The purpose of MICROAREA’s Privacy Policy is to provide transparency in the information on how we treat your data and to protect the information on the Internet and the data that the user may enter on the website.

The User is hereby informed that MICROAREA may process the personal data provided by the User through the online forms or during the purchase process of any of MICROAREA’s products, for the purposes indicated below, to the extent that there is a legal basis for each processing as explained below:
(a) To grant the User access to, and use of his or her personal space in the private area of the web pages of products and services offered by MICROAREA.
(b) To manage purchases and requests made by the User on MICROAREA’s web pages.
(c) Inform the User by any means, including sending commercial communications to the e-mail address provided by the User, of MICROAREA products and services similar to those purchased by the User.
(d) To carry out promotional activities about other MICROAREA products and services, including sending commercial communications to the e-mail address provided by the User.
(e) To carry out promotional activities, including sending commercial communications to the e-mail address provided by the User on behalf of MICROAREA, of products or services of third party companies collaborating with MICROAREA in the following sectors: finance and banking, insurance, training, publishing and publications, trade fairs and events, software and computer services, telecommunications, leisure and tourism, NGOs, energy and water, automotive, optical, electronic, audiovisual and courier services. All this, as long as we request the User’s consent to do so and he/she grants it to us.
(f) To transfer personal data to authorized software distributors for the purpose of marketing only software products, solutions and services, provided that we request the User’s consent to do so and he/she grants it to us.
what is the legitimacy for the processing of your personal data?
The legal basis for the processing of data for purposes (a) and (b) is the performance of the contract for the provision of services and/or the purchase of the relevant products.
The legal basis for the processing of data for purpose (c) shall be both the User’s consent, if requested and granted, and MICROAREA’s legitimate interest in bringing to the User’s attention products or services similar to those previously purchased.
The legal basis for the processing of data for purposes (d), (e) and (f) is the consent that may have been requested from the User, and in no case shall the withdrawal of such consent condition the performance of the contract for the provision of services. The User’s personal data shall not be processed for these purposes if MICROAREA has not requested the User’s consent.
At the time of registration, MICROAREA shall collect and process the personal data required for registration and access to the User’s personal space. In the event that the User decides to purchase one of MICROAREA’s products or services, MICROAREA shall collect and process the data necessary to manage the purchase process (including name, surname, ID number, address, etc.). how long do we keep your personal data?
MICROAREA will keep the data of its customers for the duration of their contractual relationship and after the contractual relationship, the data will be kept for promotional activities for a period of two years, for other types of users the data will also be kept for a period of two years, (unless, in both cases, the processing is based on the consent of the User and he/she revokes it, in which case it will be kept until such revocation is received), Therefore, the data will not be kept longer than necessary for the purposes described above, without prejudice to the conservation that may be necessary for the formulation, exercise or defense of potential claims and/or as long as permitted by applicable law.
who has access to your personal data?
An optimal provision of the service that MICROAREA offers through its website may require that other third party service providers of MICROAREA access the User’s personal data as data processors. By accepting this Privacy Policy, the User understands that some of the aforementioned service providers are located in countries outside the European Economic Area or do not offer a level of security equivalent to that of Spain. In addition to the access that third party providers may have to the personal data under MICROAREA’s responsibility as national or international data processors, in the context of providing a service to the data controller, MICROAREA may transfer the User’s personal data to MICROAREA’s authorized Distributors, as mentioned in section II, provided that the User’s consent has been requested and granted by MICROAREA.
In addition to the foregoing, MICROAREA may transfer or communicate personal data in order to fulfill its obligations to the Public Administrations in cases where this is required in accordance with the legislation in force at any given time and, where appropriate, also to other bodies such as the State Security Forces and Corps and the Judiciary.
what are the users’ rights?
MICROAREA informs the User about the possibility of exercising the rights of access, rectification, opposition, deletion, portability and limitation of processing, as well as the right to refuse automated processing of personal data collected by MICROAREA.
These rights may be exercised free of charge by the User, and, if applicable, the person representing him/her, by sending a written and signed request to the following address: 2810 N Church, St Wilmington, DE, 19802. Such request must contain in the subject line the reference “Data Protection/[Name of the MICROAREA group company]” and must include the following information: name and surname of the User, address for notification purposes, photocopy of the National Identity Card or Passport, and the request in which the request is made. In the case of representation, it must be proved by means of a reliable document. Likewise, the User will be able to exercise the mentioned rights through the electronic mail info@microareanext.com.
In addition to the aforementioned rights, the User shall have the right to withdraw the consent granted at any time by means of the procedure described above, without such withdrawal of consent affecting the lawfulness of the processing prior to the withdrawal thereof. MICROAREA may continue to process the User’s data to the extent permitted by applicable law.
Likewise, when the processing of the User’s personal data for the purpose (c) is based on legitimate interest, the User may object to such processing.
MICROAREA reminds the User that he/she has the right to file a complaint with the relevant supervisory authority.
unsubscribing from the commercial communications SERVICE
As mentioned in the previous section, the User has the right to revoke at any time the consent given to send commercial communications by simply notifying MICROAREA that he/she no longer wishes to receive commercial communications. To do so, the User may either revoke his/her consent in the manner described in the previous section or click on the link included in each commercial communication, thereby cancelling the sending of electronic commercial communications.
WHaT IS THE MINIMUN AGE REQUIRED TO ACCESS OUR PRODUCT AND SERVICES?
MICROAREA’s website is not directed to persons under 18 years of age. By accepting this Privacy Policy, the User declares and guarantees that he/she is over 18 years of age.
